Terms of service

These terms are the agreement between Clear Skies Aviation Enterprise LLC, a Delaware limited liability company doing business as Brikt (“Brikt”), and the company or person that creates a Brikt workspace. They cover brikt.ai and the Brikt application. By creating a workspace, inviting collaborators, or using the service, you agree to them. If you are agreeing on behalf of a company, you confirm that you are authorised to bind it.

1. The service

Brikt is a planning-and-controls platform for capital projects. It provides a critical-path scheduling engine, a daily field check-in, blockers and delay records, reports and share links, and AI features built on Claude.

We improve the service continuously and may add, change or remove features. We will not remove a material feature you are currently paying for without giving you notice first.

2. Workspaces, members and invited collaborators

A Brikt workspace belongs to one company. The person who creates it becomes its first administrator and can invite others, set their roles, and remove them.

There are two kinds of people in a workspace, and the difference is the heart of how Brikt is priced:

  • Members of your own company occupy paid seats.
  • People you invite from other companies — subcontractors, owners, architects, consultants — are external collaborators. They are unlimited and free, and they never occupy a seat.
  • External collaborators have restricted access. Cost information, cost codes, internal notes and baseline comparisons are withheld from them.

3. Plans, seats and trials

Paid plans are priced per seat, per month, and can be billed annually or monthly. Current plans and prices are published at brikt.ai/pricing and apply from the date you subscribe.

When self-serve signup is open, new companies may start a 30-day free trial without a card. The trial is available once per company. There is no permanent free tier: the only thing that is permanently free is external collaboration, described in section 2.

Adding seats takes effect immediately and is charged for the remainder of the current period. Removing seats takes effect at your next renewal; we do not refund a seat mid-period.

We may change prices. A price change applies from your next renewal, and we will tell you before it takes effect.

You are responsible for who you invite and for what the people in your workspace do with it. Keep credentials secure, and tell us promptly if you believe an account has been used without permission.

4. Payment

Payments are processed by Stripe. Brikt does not receive or store your full card number; we hold only the subscription state and the invoice records Stripe returns to us.

Subscriptions renew automatically at the end of each period until cancelled. You authorise us to charge your payment method for each renewal, plus any seats added during the period.

If a payment fails, we will retry it and contact you. An account that stays unpaid may be restricted and then suspended; we will tell you before that happens.

Prices exclude taxes. Where sales, use or similar taxes apply, you are responsible for them.

5. Refunds

Annual plans carry a 30-day refund window, no questions asked. The window runs from the start of your paid subscription — it does not restart at renewal. So an annual renewal charge is not refundable; if you cancel after a renewal, the period you have paid for runs to its end.

Monthly plans can be cancelled at any time. The current month runs to its end and is not refunded.

Refunds over $500 are reviewed by a person before they are issued. Refunds are returned through Stripe to the original payment method.

6. Cancellation, suspension and termination

You can cancel at any time from your billing settings. Your workspace stays available until the end of the period you have paid for.

After cancellation we keep your workspace data for a limited period so that you can export it, and we will honour an export request made during that period. You can ask us to delete your workspace and its data at any time by emailing [email protected].

We may suspend or terminate access for non-payment, or for a breach of section 8 that you have not fixed after notice. Where the law and the circumstances allow it, we will tell you why and give you a chance to put it right.

7. Your data

You own what you put into Brikt. Your schedules, activities, progress, comments, blockers, delay records, attachments and generated reports are yours, and they remain yours.

You grant us the permissions we need to run the service for you: to host, store, process, transmit and display your content, and to access it when you ask us for support or when we must to keep the service secure and working.

We do not sell your data. We do not use one customer's project data to serve another customer, and we do not use your project content to train AI models. How personal information is handled — including every third-party service involved — is described in our privacy policy.

Each side will keep the other's confidential information confidential and use it only for the purposes of this agreement.

8. Acceptable use

You agree not to:

  • use Brikt unlawfully, or to store or transmit content you have no right to;
  • attempt to reach another customer's workspace, or any data you have not been granted access to;
  • reverse engineer, decompile or copy the service, or resell or sublicense access to it;
  • circumvent seat counts, permissions, rate limits or any other technical control;
  • upload malware, or interfere with the operation of the service; or
  • probe or test the security of the service without our prior written permission.

9. AI features and professional responsibility

Brikt uses Claude, from Anthropic, to answer questions about your schedule and to draft changes to it. Schedule content and the messages you send are transmitted to Anthropic to produce a response; see the privacy policy for what that means in practice.

Claude drafts. A person applies. Every AI-authored change arrives as a proposal that someone on your team reviews and applies, with a record of who applied it. Brikt does not let an AI commit a change to your schedule on its own.

AI output can be wrong, and so can any forecast. Brikt helps project teams plan, manage, document, and communicate construction schedules. Final review and responsibility for every schedule, narrative, notice, and report remain with the project team.

Brikt is a software company. Nothing produced in or by the service is engineering, architectural, legal or accounting advice. Schedules, delay records, notices, narratives and reports are working documents; anything with contractual or legal consequence should be reviewed by your own professionals before you rely on it or send it.

10. Third-party services

Brikt runs on third-party infrastructure and connects to third-party tools. The current list, and what each one does, is published in our privacy policy.

If you connect Brikt to another product — for example by using the Brikt connector inside claude.ai — your use of that product is governed by that product's own terms, not by these.

11. Availability and support

We monitor the service and work to keep it available, and we will give notice of planned maintenance where that is practical.

These terms do not include a service-level commitment, and Brikt holds no security or compliance certifications today. If you need either, talk to us and we will tell you honestly where we stand.

12. Our intellectual property

Brikt — the software, the brand, the documentation and everything we create to deliver the service — belongs to us. Your subscription grants a limited, non-exclusive, non-transferable right to use it while the subscription is active, and nothing more.

If you send us feedback or suggestions, we may use them freely and without obligation to you. That does not give us any right to your project content.

13. Disclaimer of warranties

The service is provided as is. To the maximum extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted or error free, or that any schedule, forecast, report, health check or AI output will be accurate, complete or suitable for your purpose.

14. Limitation of liability

Neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost data or lost business, even if it was told such damages were possible.

Each party's total aggregate liability arising out of or relating to this agreement is limited to the amounts you paid us in the twelve months before the event giving rise to the claim.

Stated specifically, because this is planning software for construction: decisions about how a project is planned, sequenced, staffed, accelerated, claimed or defended remain yours. We are not liable for delay, disruption, acceleration or claim outcomes on your projects.

These limits do not apply to your obligation to pay amounts due, to either party's indemnity obligations, or to any liability that cannot be limited under applicable law.

15. Indemnities

You will defend and indemnify us against third-party claims arising from your content, or from your use of the service in breach of these terms.

We will defend and indemnify you against third-party claims that the service, used as permitted, infringes that third party's intellectual property. In each case the indemnified party must give prompt notice, allow the other to control the defence, and cooperate reasonably.

16. Changes to these terms

We may update these terms. For a material change affecting an existing subscription we will give at least 30 days notice, by email or in the product, before it takes effect. Continuing to use Brikt after that date means you accept the updated terms.

17. Governing law and disputes

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules.

Before starting a formal dispute, each party agrees to raise the issue in writing and to try in good faith to resolve it for 30 days. Email [email protected] to start that conversation.

If that does not resolve it, the state and federal courts located in Delaware have exclusive jurisdiction, and both parties consent to venue there.

18. General

These terms, together with the privacy policy and any order form or written agreement we sign with you, are the entire agreement between us on their subject, and they replace any earlier understanding.

Neither party may assign this agreement without the other's consent, except to a successor in a merger or a sale of substantially all of its assets. If a provision is held unenforceable, the rest stands. A delay in enforcing a right is not a waiver of it. Neither party is liable for a failure caused by events outside its reasonable control.
